The No-Fraud In On-line Divorce Pledge

We, NetDivorce,LLC, hereby pledge to our existing and future clients, without reservation or BS, that we will never engage in fraud of any kind against our clients or potential clients in seeking to obtain their business or in the conduct of our on-line divorce business. 

We take fraud to mean the obtaining of a substantive benefit (such as getting someone to hire us) by purposeful deception.  Deception means stating or implying that some material fact is true, when it is not, or vice versa, when you know that your statement or implication is not true.

Specifically, we pledge NOT to engage in any of the following frauds:

mydivorcepapers.com SELLS YOU BLANK FORMS THAT YOU CAN DOWNLOAD FREE FROM STATE JUDICIAL COUNCIL WEBSITES

Details: Since approximately 2001, this site has been selling packages of blank divorce forms to people who apparently don't know that they can download the same forms free from state judicial council and state websites.  It has charged either $25 or $30 per package.

TRICKS YOU INTO HIRING THEM BY CLAIMING THEY HAVE OVER 1500 INDEPENDENTLY CERTIFIED CLIENT TESTIMONIALS. THEY DON'T

Details:
These two websites use the non-existent certifiedcomments.com service to represent to you that they have over 1500 verified testimonials from clients. This is intended to convicnce you to hire them because they must be an honest and efficient company.

Certifiedcomments.com has a private domain registration. They pay extra so that you can't tell who owns the website, even though it is a website that claims it deals in trust and transparency. It exposes no address, phone number or email address on its site. It does not respond to messages sent via a web form on its site. A Google search for "certifiedcomments.com" reveals only the two listed divorce websites as being clients of certifiedcomments.com. Certifiedcomments.com is hosted on the very same web server in Irvine, CA as the two divorce websites. The domain name, certifiedcomments.com was created for the first time in July 2013, but it has "guaranteed" testimonials for these two divorce sites that date back to June 2012.

rocketlawyer.com USES BAIT AND SWITCH. PROMISES A "FREE" MARITAL SETTLEMENT AGREEMENT BUT YOU HAVE TO PROVIDE A CREDIT CARD TO GET IT AND THE "FREE" DOCUMENT IS USELESS; THEY THEN TRY TO SELL YOU A LEGAL SERVICES PLAN THAT DOESN'T COVER DIVORCE!

Details:
  The Marital Settlement Agreement provided was of low quality. It did not include certain mandatory wording required by California courts and would not have been accepted for filing by those courts, including those in at least Los Angeles and Orange Counties. Further, by the time the site requests your credit card, you have invested 30 minutes in answering the online interview questions. If you select the "free week" option so that you don't have to pay immediately, you still have to provide your credit card and you can't make any further changes to the agreement. Modifications are almost always needed.  It may technically be "free," but it has been a complete waste of your time, which you may value, and is unfileable anyway. 

While you have been pursuing a "free" document, they've got your email address, your private marital information (they are partially owned by Google) and your credit card. 

Unless you opt-out after the free week, they charge you $49 per month for a pre-paid legal services plan THAT DOES NOT INCLUDE DIVORCE! But you can hire one of their subscribed lawyers to handle your divorce at either "pre-negotiated rates" or $125 per hour, whichever is greater.

This site is only a front for selling a $49 per month legal services plan or for referring you to lawyers who have subscribed your zip code.

ADVICE: IF YOU WANT TO HIRE A LAWYER OR BUY A LEGAL SERVICES PLAN, DO SO, BUT YOU SHOULD SELECT THE ONE YOU WANT. DON'T LET ROCKET LAWYER CHEAT YOU INTO ITS PLAN JUST BECAUSE YOU ARE GETTING A DIVORCE.

USES AN AFFILIATED WEBSITE, MYDIVORCEDOCUMENTS.COM (see above) WHICH CLAIMS THAT IT HAS "REVIEWED" 5 ONLINE DIVORCE SITES AND (WHAT A SURPRISE!)RECOMMENDS THE TWO AFFILIATED DIVORCE SITES AS THE BEST:

Details: In July 2014, its owners stopped using mydivorcedocuments.com to sell packages of freely available blank forms (see above) and changed its fraudulent use. 

Now, mydivorcedocuments.com pretends to be an online divorce site review service. It claims to review divorce sites as an independent "expert." It's "reviews" are very thin and obviously contain no information that cannot be read on the websites of the services reviewed. There is no evidence that mydivorcedocuments.com even hired the sites it was reviewing. And why would it when it knew that it was going to recommend its 2  affiliated sites? 

It pretends that its reviews and recommendation are legitimate, third party arms-length deals. However, proof that all three sites are affiliated is that (1) a phone number that used to appear as a customer support line on mydivorcedocuments.com in March 2011 and at other times, 1-800-604-2860, is now a customer support line for mydivorcepapers.com. (2) the Better Business Bureau record for mydivorcedocuments.com in June 2004 and at other times, lists Jason McClain, the owner of mydivorcepapers.com as the  primary contact for mydivorcedocuments.com; and (3) at different times during 2013 and 2014, when mydivorcedocuments.com had begun to offer an online divorce service, as well as selling free forms, it contained links to  both mydivorcepapers.com and idivorceforms.com as its own divorce preparation service.
